When these terms apply
These terms apply whenever you:
- Use the boomworks.es website
- Contact us through the form or by email
- Ask us for a quote, proposal, or scope of work
- Receive a draft proposal, mockup, or estimate from us
- Read or download anything we publish (blog posts, case studies, etc.)
By doing any of the above you agree to these terms. If you don't, please don't use the site.
Once you become a client
If you and Boomworks sign a Master Services Agreement and one or more Statements of Work, those documents (not these terms) govern the work, the deliverables, the payment, and the relationship. These terms continue to apply only to your general use of the website.
Using the site
You can browse, read, and download anything we publish on the site for your personal or business reference. You can quote short extracts in your own work as long as you attribute Boomworks and link back. You can't:
- Republish our content elsewhere as if it were your own
- Reproduce our portfolio screenshots, client logos, case-study imagery, or other visual assets in your own materials without our written permission
- Try to break, abuse, or reverse-engineer the site, its underlying code, or its infrastructure
- Send automated traffic, scrape content at scale, or attempt to overwhelm the site
- Use the site for anything unlawful
Contacting us
When you fill in the contact form or email us, you're starting a conversation, nothing more. Sending an enquiry doesn't create a contract or oblige us to take on your project. It also doesn't oblige you to anything. We aim to reply within a few business days but make no promise on response time.
If you share information with us as part of an enquiry, proposal, or discovery call, we'll treat it with reasonable confidence and won't use it for anything other than evaluating whether we can help. We won't share it with third parties without your permission. If something is particularly sensitive, please say so, or sign an NDA with us first and we'll happily honour it.
We may decline any project for any reason, including capacity, fit, or specialism. We'll usually tell you why, and we'll point you elsewhere if we can.
Quotes, proposals, and estimates
Any quote, proposal, fee estimate, or scope summary we send you before a contract is signed is:
- An indication, not a binding offer, unless we say otherwise in writing
- Valid for 30 days from the date we send it, unless we state a different period
- Subject to refinement once we understand the project in more detail
- Not a contract - we only become contractually committed once both sides have signed a Master Services Agreement and a Statement of Work
Drafts, mockups, sketches, sample copy, or sample code we share at pitch stage remain our property and may not be used, adapted, or shown to other suppliers without our written permission.
Free content we publish
Blog posts, articles, case studies, and similar content we publish on the site are © Boomworks, S.L. They're free to read. They're free to share by linking. They're not free to copy, republish, or build on commercially without our permission. If you'd like to do something more substantial with them (translate one, syndicate one, quote at length), get in touch and we'll usually say yes.
We try to keep what we publish accurate, but it's general information, not professional advice for your specific situation. Don't make important decisions based solely on what you read here without taking your own advice.
Third-party links
The site may link to other websites (clients, tools we recommend, articles we found useful). We don't control those sites, we don't endorse everything on them, and we're not responsible for what happens when you visit them. Read their own terms.
Liability
We provide this website and the things we publish "as is." To the fullest extent permitted by law, Boomworks is not liable for:
- Interruptions, errors, or unavailability of the site
- Inaccuracies or out-of-date information on the site
- Any loss arising from your reliance on free content we publish
- Damage caused by malware or technical failures originating outside our control
- The content or behaviour of third-party sites we link to
Nothing in these terms limits any liability that cannot be limited under applicable law (such as for personal injury caused by negligence or for fraud).
If you have a signed contract with us, the liability and limitation clauses in that contract govern the work. These website terms don't override them in either direction.
Privacy and cookies
How we handle your personal data is set out in our Privacy Policy. What the site does (and doesn't) store on your device is in our Cookie Policy.
Changes to these terms
We may update these terms from time to time, usually because the law changes, our processes evolve, or we add new things to the site. The current version is the one published on this page, and the date below tells you when it was last updated. Continued use of the site after we update the terms means you accept the new version.
If you've already signed an MSA with us, changes to these website terms don't change the MSA. The MSA can only be varied as it provides for in its own terms.
If we disagree
We'd much rather work things out directly. Email contact@boomworks.es with whatever the issue is and we'll do our best to sort it.
If a dispute can't be resolved that way, these terms (and any non-contractual obligations arising from them) are governed by Spanish law, and the courts of Alicante have exclusive jurisdiction, except where mandatory consumer-protection law gives a consumer the right to bring proceedings in their place of residence.
For disputes arising under a signed contract with us, the governing-law and jurisdiction clause in that contract applies instead.
